Blogger Kevin Cogill charged with felony in leak of Guns N' Roses songs

When five FBI agents arrested Kevin Cogill at his Culver City flat, it marked the newest weapon in the amusement industry's war on plagiarization: felony charges against nickel-and-dime bootleggers.


Cogill posted nine leaked songs from an unreleased Guns N' Roses album, which has been in the whole caboodle for more than a decade, on his music blog in June. The site crashed under the traffic, and he distant the songs after a few hours when the Los Angeles-based rock band's lawyers complained.


Now he faces up to three days in prison house and $250,000 in fines. On Wednesday he became the first Californian charged under a 3-year-old federal anti-piracy law that makes it a felony to distribute a copyrighted work on computer networks before its release.






"In the past, these may have been viewed as victimless crimes," aforesaid Craig Missakian, an assistant U.S. attorney in Los Angeles world Health Organization built the case with the FBI and recording-industry investigators. "But in realness, there's significant damage. This law allows us to prosecute these cases."


Cogill, 27, was arrested Wednesday and released on $10,000 bond. He was not required to enter a plea. His public defender, Anthony Eaglin, declined to comment.


"I hope he rots in jailhouse," said Slash, the early Guns N' Roses lead guitarist. "It's going to affect the sales of the phonograph record, and it's not fair. The Internet is what it is, and you have to deal with it accordingly, but I think if someone goes and steals something, it's theft."


The entertainment industry has long fought to protect official press release dates. It contends that sales ar lost when a film or song is available free on the Internet before it hits stores. Leaked songs are often unfinished and of poor sound quality.


Pre-release piracy "pops the balloon," said Eric German, a partner with Mitchell, Silberberg & Knupp who has represented the recording industry in piracy cases. "It rips up the lottery ticket. It takes the wind out of everything."


The Recording Industry Assn. of America has long relied on polite lawsuits to combat piracy. But the Family Entertainment and Copyright Act of 2005 gave it a new malleus -- felony charges with stiff penalties for posting even one song before its release.


The law has been secondhand only a few times, mostly to tackle large commercial piracy rings. But in 2006, two people were charged with distributing a reading of a Ryan Adams & the Cardinals album, "Jacksonville City Nights," on the Internet before it hit stores. They were sentenced to two months of house arrest and two years' probation.


Fans of Guns N' Roses take experienced a long drouth of new recorded real. Led by lead isaac M. Singer Axl Rose, the rockers have been working on their record album, "Chinese Democracy," on and off since the 1990s.


Cogill used to work for Universal Music and immediately works at entertainment internet site Crave Online. Writing under the call "Skwerl," he uses his blog, Antiquiet, to talk about American politics and the music industry.


In early June, he expressed his appreciation for Guns N' Roses, noting that he had waited half his life for a new album.


"The more than you [mess] around with the inside information, the more likely the album is to news leak on the Internet, spoiling whatever prominent plans you're cooking up anyway," he wrote, addressing Geffen Records, the band's label and a unit of Universal.


On June 18, he aforementioned he had received nine-spot "Chinese Democracy" tracks from an unknown source and made them available for streaming, merely not download, on Antiquiet. He contended that if the album was upright -- and he thought it was -- it would do well financially, in malice of any leaks.


After he removed the tracks, the FBI interviewed Cogill at his office and home, seeking the source of the leaked songs.


"I've been asked if my legal troubles are over," he wrote after the FBI's visit. "The answer is that they haven't begun."


No one came to the door at Cogill's home Thursday. A man wHO answered his phone declined to distinguish himself just said Cogill wasn't granting interviews.


In an e-mail, young man Antiquiet blogger Britney Bernstein said Cogill's case was building buzz for "Chinese Democracy." "Any publicity this album gets is good publicity," she said.


The band released a statement: "Presently, though we don't support this guy's actions at that grade, our interestingness is in the original source. We can't scuttlebutt publicly at this time as the investigation is ongoing."

GNR's 'Democracy' might be retail exclusive

Negotiations with Wal-Mart, Best Buy under way




NEW YORK -- The June outflow of nine-spot allegedly "down pat, finished" tracks from Guns N' Roses' long-delayed "Chinese Democracy" spurred a renewed round of chatter about whether the Axl Rose-led band volition finally acquittance the 14-years-in-the-making album.

But some concrete signs are finally emerging that the album's release could be imminent. That's because, according to sources, negotiations are under way for "Chinese Democracy" to fall out as an exclusive at one of the big boxes -- either Wal-Mart or Best Buy.

Negotiations are too ongoing to have conventional record caller distribution, some other source said.

Guns N' Roses is now managed by Irving Azoff's Front Line Management, and Azoff is a well-known proponent of issuing albums exclusively through retailers. He released the Eagles' "Long Road Out of Eden" through Wal-Mart, much to the humiliation of other merchants.

Most of late, it became known that AC/DC's next album will come proscribed exclusively through Wal-Mart. Merchants were peculiarly incensed that the deal was on the face of it struck with the benediction of Columbia.

It's unclear wHO initiated the Guns N' Roses exclusive negotiations -- Front Line or Interscope, the band's label.

Representatives at Front Line and Interscope with cognition of the situation couldn't be reached for comment by deadline. A Wal-Mart representative says the mountain chain couldn't reassert this fall's exclusives. Best Buy representatives couldn't be reached for comment by deadline.

Originally determination success as the singer/frontman of Seattle's Soundgarden, Chris Cornell also forged a successful solo calling later the band's 1997 demise. Likewise Cornell's brobdingnagian talents displayed with Soundgarden, he organized a protection for late Mother Love Bone singer Andrew Wood in the form of 1990's Temple of the Dog propose, which was far more stripped-down. Cornell's first officially released solo composing, the acoustic "Seasons," was the highlight of the 1992 motion impression soundtrack Singles. His bluesy voice also worked surprisingly intimately on a brilliant cover of Jimi Hendrix's "Hey Baby (New Rising Sun)" on the 1993 Stone Free: A Tribute to Jimi Hendrix compiling (under the anonym MACC). He too ground clock time to pen songs for former acts of the Apostles, such as Flotsam & Jetsam and Alice Cooper, as well as producing the Screaming Trees' 1991 button Uncle Anesthesia. After Soundgarden's death in April of 1997, Cornell slowly just sure enough began to set a solo album together with his friends from the band Eleven.


Finally issued in 1999, Euphoria Morning was a difference from his former band's sound, as it was in a more singer/songwriter mold, which focused more on Cornell's vocals and lyrics than substantive guitar riffs. Shortly after its release, Cornell launched his first solo duty tour, commixture songs from all eras of his career. After wrapping up the aforesaid duty tour in early 2000, a lukewarm remix of the Euphoria Morning track "Mission" (retitled "Mission 2000") was included on the Mission Impossible 2 soundtrack. It appeared as though Cornell would claim a break from music for a piece, as his wife gave birth to the couple's number one nestling in June of the same year, simply by late 2000, Cornell found himself involved in a picture that promised to be a classical hard rock 'n' roll collaborationism.


Passion Against the Machine decided not to break up after longtime singer Zack de la Rocha left wing the stria that winter, simply sooner they would discover another isaac Bashevis Singer and dribble on under a different refer. Cornell accepted an invitation to jam and pen a few songs (which early Rage guitar player Tom Morello described as "in truth groundbreaking") and, shortly thereafter, formally joined forces with the former Rage members under the nickname Audioslave. Cornell left wing the stria that same year, citing the usual "irreconcilable differences," and began work on his second solo record, 2007's Carry On, a topical, biographic, and musically befuddled whirlwind featuring a cover version of Michael Jackson's "Billy Jean" and "You Know My Name" from the Bond film Casino Royale.

Bono and Bob slam French aid record

Bono and Bob Geldof have challenged French President Nicholas Sarkozy to fulfil his promise to increase aid to Africa in line with commitments made at the G8 summit in 2005.
According to Reuters, the G8 agreed to double aid to Africa by 2010 at the 2005 summit at Gleneagles in Scotland but advocacy group DATA, which tracks aid spending, revealed that the G8 had collectively delivered just 14% of what was promised.
Geldof told a news conference in Paris: "It's a disgrace that the rich world, France included, has failed so utterly and miserably."
The DATA report, which Bono and Geldof were launching, says that France is among the worst G8 nations in terms of matching the promises it made.
It claims that aid from France to sub-Saharan Africa decreased by $66 million between 2006 and 2007 and that less than 7% of the funds promised have been delivered so far, making France the second worst G8 nation behind Italy.
"That's the measure of the failure of the political class of this country," said Geldof.
Bono said: "I have high hopes for President Sarkozy. I believe his hard-headedness might be necessary to work on some of these problems."
Japan has performed best of the G8, having already matched its aid commitments two years ahead of schedule.

Arcade Fire record soundtrack for 'Donnie Darko' director's new film

Arcade Fire are recording the film soundtrack to 'Donnie Darko' director Richard Kelly's next film 'The Box'.

The film will star Cameron Diaz and James Marsden.

For the soundtrack Arcade Fire are working with producer Markus Dravs, who most recently worked with Coldplay on their upcoming 'Viva La Vida or Death And All His Friends' album.

The band's film score was being kept quiet, that is until Dravs posted on his website: "Having finished Coldplay's forthcoming album 'Viva La Vida' - now off to Canada to work with Arcade Fire on a soundtrack for the forthcoming Richard Kelly film."

The flick currently being edited, with the intention of a release later in the year, reports Angry Ape.

Lohans unhappy David Letterman called Ali 'Lindsay'

Lindsay LohanDavid Letterman calling Ali Lohan 'Lindsay' during a recent interview this week has caused fury in the Lohan camp.


When Ali appeared on The Late Show Tuesday to promote her new reality show, Living Lohan, Letterman mistakenly referred to the 14-year-old as Lindsay; and the pair both laughed it off.


However, the joke is now over, according to a source close to the Lohan family.


"It's a sticky area because Ali�s rising star is both enabled and discredited by her sister�s notoriety," said the source. "Ali doesn�t want to ride Lindsay�s coattails, and Dina has always believed Ali is a great talent in her own right.


"When he calls her Lindsay, it reminds everyone of how much she emulates her sister�s behavior � she�s basically adopted her voice and look. We can expect it will be hard for Ali to stay out of the tabloids."

Hilton slams media reports as lies

Paris Hilton has hit out at the media saying that 90% of stories about her are "complete lies".
According to Reuters, the heiress said: "I don't pay attention to lies because I am a good person, I work very hard and I've built this empire on my own. I think this is an inspiration for a lot of girls out there."
When asked about her grandfather Barron Hilton's recent decision to donate 97% of his $2.3bn wealth and possibly her inheritance to charity, she said: "It won't affect me anyway. My grandfather is an incredible man. He is very generous. And what he is doing is amazing."

James Bond to wed in Quantum Of Solace?

British actress Gemma Arterton has hinted that James Bond may tie the knot in the forthcoming 007 movie.
The 22-year-old star told a US TV reporter that she and Daniel Craig had been shooting scenes in a honeymoon suite for the film, which is titled 'Quantum of Solace'.
The surprised journalist asked: "Honeymoon suite?", prompting Arterton to reply: "I think I've said too much."
The actress, who can currently be seen in 'St Trinian's', plays an MI6 agent working at the British consulate in Bolivia in the new Bond film.
Bond has previously been married on screen. In the 1969 movie 'On Her Majesty's Service', George Lazenby's Bond married Tracy Draco (Diana Rigg). However, she was murdered in a drive-by shooting on their wedding day.

Album Review




Success impacts on performers in a number of different ways. For Moby, the ten million copies sold of Play - achieved partially by the allegedly ambiguous ubiquity of it's licensing - prompted several years in which the man who once released an all punk album called Animal Rights fell into the bourgeois trap of being more famous for socialising than making music. Now 42, teetotal and more frequently referred to as a veteran than he'd prefer, Last Night arrives with the high concept of soundtracking a timeless Manhattan night out, attempting to flit between the styles that made earlier work such as Everything Is Wrong both more carefree and dance floor ready.



At the beginning the results are undoubtedly rejuvenating for both artist and audience. Opener Ooh Yeah revels in it's lo tech authenticity and recalls ‘e’ toting crossover act The Shamen, I Love To Move In Here is a truly gorgeous slice of nascent house magic and as the title suggests Everyday It's Like 1989 is so rave it might as well be a baby's dummy. We are indeed having it. Old habits it would then appear however to die hard, as both Live For Tomorrow and the syncopated hip-hop of Alice would have nestled snugly into Play's sanitised genre tourism. Worse still, much of the rest is subsumed into a gentle but placid sense of ambient nothingness with the tempo slowing to chill out room pre-dawns, although at least the rippling Sweet Apocalypse serves as a reminder that the Aphex Twin's stunning Selected Ambient Works has just been re-issued.



If Last Night is to be judged on following it's principle, then Moby is a very strange tour guide indeed, rushing the listener straight to the club and then having them in a cab way before bedtime. But the issue here isn't just odd sequencing; any sense of nostalgia generated misses the point. One listen to compilations of the early 90's most hedonistic moments reveals a different truth in the inevitable unevenness, bleeping idiosyncrasies and a lack of sheen which were their strength, produced as they were by largely faceless auteurs. It should also not be ignored that much of this Diaspora was specifically designed to work best in the context of a warehouse sound system and to complement the physical effects of exaggerated levels of dopamine, serotonin and adrenalin. It is for this reason most tellingly that the more the obvious retro elements attempt to communicate a sense of history, the more they sound counterfeit. Loving an era's soundtrack and updating it isn't impossible, as records by Metro Area and more recently Hercules and Love Affair have proven, but to do likewise needs a display of greater conviction than this.

Kidman gets Valentine's dedication

Country singer Keith Urban made a Valentine's Day dedication to his pregnant wife Nicole Kidman during a concert at Madison Square Garden last night.
According to People magazine, the singer paid tribute to his film star wife during the concert, which he co-headlined with 'American Idol' star Carrie Underwood.
Urban dedicated the track 'Got It Right This Time' to Kidman, who is currently in her native Australia.
He said: "It's Valentine's Day here tomorrow, but today it's already Valentine's Day in Australia."
